The Mediation Process
In mediation, both parties and their attorneys work with a mediator to negotiate a settlement both can agree on. The mediator assists both parties in coming to a resolution, usually by sending offers of settlement back and forth between both parties. The mediator does not make a final decision or give advice to either party. If some contested issues remain post- mediation, the parties are free to continue settlement negotiations through their attorneys and/or prepare to resolve the case at trial.
