Assuming a loan is a good choice for those with good credit who do not want to pay any additional fees. However, not all mortgages include an assumption claim option. This can make it extremely difficult for one spouse to take over the home without refinancing the loan.

When dealing with property division during a divorce, it’s extremely helpful to work with an attorney. One spouse may want the other to buy them out of the loan. This individual will need to raise the funds necessary to pay their partner half of the equity in the home. Mortgages are not the only property that couples need to divide.
